Why is a Rental Agreement Important?
A rental agreement regulates the relationship between landlord and tenant and protects both parties. A professionally drafted agreement can prevent disputes, save money and ensure each side knows what is expected.
1. Lease Term and Option to Extend
Clearly define the lease term, start and end dates. If there is an option to extend – specify the conditions, including any change in rent. It is advisable to set a notice period of 60–90 days before the option expires.
2. Rent and Payment Method
State the exact amount, payment date (e.g. first of each month), and method (bank transfer, cheques). Define what happens in case of delay – is there late interest?
3. Guarantees and Security
Bank guarantee, promissory note, deposit – define what security is required, for how much, and in what cases the landlord may use it. The Rent and Loan Law sets limits on the amount of security (for residential leases).
4. Maintenance and Repairs
Define in advance who is responsible for what: reasonable wear and tear (usually the landlord), damage caused by the tenant (the tenant). It is advisable to prepare a photographed entry protocol.
5. Use of the Property and Alterations
Define the purpose of the lease (residence only, for example), maximum number of occupants, and whether alterations are allowed (painting, installing air conditioning). Specify whether written consent from the landlord is required.
6. Early Termination
What happens if one party wants to end the agreement early? Define clear conditions: notice period, obligation to find a replacement tenant, agreed compensation. This clause prevents serious disputes.
7. Arbitration or Mediation Clause
Consider adding a clause requiring the parties to go to mediation or arbitration before court proceedings. This saves time, money and stress for both sides.
